Welcome to Mind to Body Pty Ltd (ABN 80 132 147 169) By accessing or using this website, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions. Mind to Body reserves the right to amend or update these TCS at any time and without notice. Any changes to the TCS will only apply to orders placed on or after the effective date at which they were modified. In the event that the TCS are modified, such modifications shall not change the TCS that Customer had accepted at the time the order was made.
1. Privacy policy
Please review our Privacy Policy, which forms a part of these Terms and Conditions and governs your visit to the Site, so that you may understand our privacy practices.
2. Product safety information
Each of our products comes with instructions for use. When misused, a candle or candles can cause harm to persons and property and Mind to Body advises that each Customer carefully read the instructions on the product. Mind to Body shall not be responsible for any damages or losses of any kind resulting from Customer(s) misuse of the Product from failure to adhere to the forgoing safety protocols.
3. Eligibility
To be eligible to purchase goods on this Site and to lawfully enter into and form contracts on this Site under Australian law you must: (a) register on the Site; and (b) be the holder of a valid debit/credit card. You must not use this Website if you are not of a legal age or capacity to form a binding contract with us.
4. Changes made to products
Mind to body reserves the right to change or discontinue a Product, orders already placed at the time of said change(s). During the purchase process, Mind to Body will notify Customers if their order cannot be processed due to certain Product unavailability. Prices for our products are subject to change without notice.
5. Language
This contract shall be concluded in English.
6. General conditions
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
7. Your account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Mind to Body is not responsible for third party access to your account that results from theft or misappropriation of your account. Mind to Body and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
Mind to Body does not knowingly collect, either online or offline, personal information from persons under the age of 18. If you are under 18, you may use Mind to Body website only with permission of a parent or guardian.
8. User comments and feedback
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You are granted a non-exclusive, non-transferable, revocable license to access and use Mind to Body strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Mind to Body Pty Ltd Company that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as but not limited to, text, graphics, logos, button icons, images, audio clips, data, as well as the data compilation thereof, and any software used on the Site, is the property of Mind to Body Pty Ltd and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Mind to Body content is not for resale. Your use of the Site does not entitle you to make any unauthorised use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Mind to Body the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Mind to Body. 10. Ordering and payment
You will be guided and offered the opportunity to review your proposed order and confirm or correct it prior to finally placing your order. You can place your order by clicking on the Submit button at the end of the on-line order process on our Mind to Body website.
Once you have placed your order, we will send to you an email acknowledgement providing you with the details and value of your order, which has been debited to your account.
Unless we have notified you that we cannot accept your order, our acceptance of your order and the completion of the contract between you and Mind to Body will take place when we have dispatched the goods purchased by you. Mind to Body cannot change, add to or cancel an online order once payment has been received.
Payment is required at the time of checkout on our Mind to Body website. You many pay using any of the methods specified in the Payment section of this Site.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, whether in advance or subsequent to a payment, we will not be liable for any delay or non-delivery.
11. Risk of loss
Risk in the goods will pass to you upon delivery to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Mind to Body, its officers, directors, employees, agents, licensees and suppliers from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, Violation of these terms and conditions or any activity related to you or any other person accessing this website resulting from any third-party claim, action or demand resulting from your use of Mind to Body website.
13. Complaints

14. Disputes
Your use of this Website and any purchase by you of any goods from Mind to Body shall be governed by Australian law and the parties here to submit to the exclusive jurisdiction of the Australian courts.
15. No partnership or agency agreement
Nothing contained in these Terms and Conditions shall be construed as creating any agency, partnership, or other form of joint enterprise between you and Mind to Body Pty Ltd.
